Qu\u2019est-ce qu\u2019un DEEP ?<\/strong><\/p>\n

Dispositif d\u2019Enregistrement Electronique Partag\u00e9e (DEEP), c\u2019est ainsi que le l\u00e9gislateur a choisi de d\u00e9nommer les technologies plus commun\u00e9ment d\u00e9sign\u00e9es sous le terme de Blockchain ou Distributed Ledger Technology (DLT). On notera au passage le clin d\u2019\u0153il consistant, en francisant les termes, \u00e0 produire un acronyme \u00e0 consonance anglophone qui veut dire \u00ab\u00a0profond\u00a0\u00bb ou encore \u00ab\u00a0compliqu\u00e9\u00a0\u00bb.<\/p>\n

Cependant, dans son rapport soumettant l\u2019ordonnance \u00e0 la signature du Pr\u00e9sident de la R\u00e9publiquei<\/sup>, la Direction G\u00e9n\u00e9rale\u00a0du Tr\u00e9sor pr\u00e9cise avoir surtout fait\u00a0preuve,\u00a0en choisissant cette d\u00e9nomination,\u00a0de prudence par rapport \u00e0 de futures \u00e9volutions technologiques.<\/p>\n

Deux domaines d\u2019applications<\/strong><\/p>\n

D\u2019un point de vue chronologique, on retrouve pour la premi\u00e8re fois la mention d\u2019un DEEP dans l\u2019article L. 223-12 de l\u2019ordonnance du 28 avril 2016[i]<\/a>, cr\u00e9ant la possibilit\u00e9 pour des interm\u00e9diaires r\u00e9gul\u00e9s par l\u2019Autorit\u00e9 des March\u00e9s Financiers (AMF) de proposer, via leurs sites web, des bons de caisse (titres de cr\u00e9ance de maturit\u00e9 1 mois \u00e0 5 ans maximum) \u00e9mis par des \u00e9tablissements de cr\u00e9dit ou des commer\u00e7ants, donnant ainsi naissance aux minibons. L\u2019id\u00e9e du l\u00e9gislateur a \u00e9t\u00e9 d\u2019autoriser, \u00e0 titre d\u2019exp\u00e9rimentation en grandeur nature, un DEEP pour permettre \u00e0 ces interm\u00e9diaires d\u2019enregistrer les transactions d\u2019acquisitions et de cessions de minibons.<\/p>\n

En juin 2016, le minist\u00e8re des Finances a ensuite annonc\u00e9 travailler sur un deuxi\u00e8me chantier pour utiliser le DEEP en faisant adopter l\u2019amendement n\u00b0 1507[i]<\/sup><\/a>\u00a0autorisant le Gouvernement \u00e0 l\u00e9gif\u00e9rer par ordonnance\u00a0sous 6 mois\u00a0pour adapter le droit applicable aux titres financiers et aux valeurs mobili\u00e8res non c\u00f4t\u00e9s.<\/p>\n

Ces travaux ont donn\u00e9 lieu \u00e0 deux textes subs\u00e9quents.<\/p>\n

Le premier, le 9 d\u00e9cembre 2016, au travers de l\u2019article 120 de la loi n\u00b0 2016-1691[ii]<\/sup><\/a>\u00a0relative \u00e0 la transparence, \u00e0 la lutte contre la corruption et \u00e0 la modernisation de la vie \u00e9conomique, se contente de prolonger l\u2019autorisation pour\u00a0le gouvernement \u00e0 l\u00e9gif\u00e9rer par ordonnance sur le sujet.<\/p>\n

Le second, publi\u00e9 le 8 d\u00e9cembre 2017[iii]<\/sup><\/a>, soit tout juste le d\u00e9lai de 12 mois impos\u00e9 par le texte pr\u00e9c\u00e9dent, modifie le Code de commerce et le Code mon\u00e9taire et financier pour y inscrire le DEEP comme dispositif juridiquement reconnu, tenant lieu d’inscription en compte.<\/p>\n

Alors, la France championne\u00a0du droit des blockchains ?<\/strong><\/p>\n

Pas tout \u00e0 fait\u2026En effet, bien que Bercy clame haut et fort que la place financi\u00e8re parisienne est la premi\u00e8re a avoir int\u00e9gr\u00e9 la technologie Blockchain dans la loi, tous les textes cit\u00e9s pr\u00e9c\u00e9demment sont pour le moment lettres mortes en attente d\u2019un d\u00e9cret en Conseil d\u2019Etat.<\/p>\n

Celui-ci doit d\u00e9finir les caract\u00e9ristiques techniques, notamment en mati\u00e8re d\u2019authentification, de ce DEEP. Peu de choses transparaissent sur l\u2019\u00e9tat d\u2019avancement de ces travaux par opposition \u00e0 ceux de la repr\u00e9sentation nationale trait\u00e9s ici<\/a>. Les ing\u00e9nieurs \u00e9tant sans doute rares dans le corps des Conseillers d\u2019Etat, il semblerait que l\u2019ANSSI<\/a> soit en support \u00e0 ces travaux.<\/p>\n

Alors, la Blockchain dans le droit fran\u00e7ais, op\u00e9ration de communication ou volont\u00e9 de faire en sorte que la France ne rate pas le train\u00a0comme cela a \u00e9t\u00e9 le cas avec le r\u00e9seau Internet ? A n\u2019en pas douter, la France est tiraill\u00e9e entre cette volont\u00e9 d\u2019accompagner une innovation de premier plan tout en se montrant ferme quant aux \u00e9cueils li\u00e9s aux crypto-actifs et \u00e0 leur r\u00e9putation sulfureuse.<\/p>\n

Nous ne manquerons donc pas de suivre de tr\u00e8s pr\u00e8s ce feuilleton juridique dont le prochain \u00e9pisode devrait avoir lieu avant le 1er<\/sup> juillet 2018, date \u00e0 laquelle devrait para\u00eetre, au plus tard, le d\u00e9cret d\u2019application.<\/p>\n
